1. GENERAL PROVISIONS

1.1. These rules (hereinafter - Rules) constitute an agreement between MB ST Home, legal entity code 307060259, registered office address Žirgo g. 2, 10221 Vilnius (hereinafter - Seller) and You, under which the Seller will provide You with the opportunity to purchase goods offered in the https://kilimunamai.lt/ online store (hereinafter - E-store) (hereinafter - Goods).

1.3. You have the right to purchase in the E-store only if you can enter into a binding agreement with the Seller under applicable laws, and only if you comply with these Rules and applicable laws. If you are under 18 years old, you can purchase in the E-store only with the consent of your parents or other legal representatives. By placing an order, you confirm that you are 18 years of age or older or have the consent of your parents or other legal representatives.

2. PURCHASING IN THE E-STORE

2.1. When you visit the E-store and select Goods, a shopping cart is formed based on this selection.

2.2. After forming the shopping cart, you must enter the data necessary for the delivery of the selected Goods. Make sure that the provided data is correct and that the ordered Goods meet your preferences. You have the opportunity to correct errors, if any, before confirming the order. The data you provide is processed for the purposes and in the manner specified in the Privacy Policy.

2.3. You agree that by placing an order in the E-store, you undertake to pay the price indicated in the order for the Goods. The price of the Goods indicated in the E-store and in the order includes all taxes. Goods purchased in the E-store will be delivered to you free of charge for orders from 100 EUR, throughout Lithuania, except for the Curonian Spit. The delivery price to the Curonian Spit is 30 EUR. Prices in the E-store and in the order are indicated in Euros.

2.4. You can pay for the Goods using the following methods: bank transfer, Paysera, other methods indicated in the E-store.

2.5. Payment must be made immediately after placing the order.

2.6. After you confirm the order, the Seller receives all information about it. The order is considered placed from the moment it is received by the Seller. At the same time, in this case, it is considered that a contract has been concluded between you and the Seller. However, the Seller is obliged to fulfill such a contract only from the moment the Seller receives confirmation from the payment service provider about the payment for the Goods.

2.7. After placing the order, an email will be sent to the email address you provided, indicating the ordered Goods and the data you provided.

2.8. Upon receiving notification that you have paid for the ordered Goods, the Seller undertakes to fulfill your order.

3. CHARACTERISTICS AND QUALITY OF GOODS

3.1. The characteristics of the Goods are indicated in the E-store next to the description of each Good. The Seller aims to ensure that the Goods comply with the requirements established by legal acts and are suitable for use according to their purpose.

3.2. By placing an order, you confirm that you are familiar with and understand that the Goods indicated in the E-store may not match the actual size, shapes, and color of the Goods in terms of color, shape, or other parameters due to the characteristics or settings of your monitor or other device. Such differences will not be considered defects of the Goods, except in cases where the discrepancies are caused by the actions of the Seller or related third parties.

3.3. The Seller undertakes to transfer Goods that comply with the information indicated in the description of the Goods provided in the E-store. The Seller also undertakes to provide you with the assortment and quantity of Goods indicated in the order, but is not responsible in cases where the assortment or quantity of the transferred Goods is not accurate due to you incorrectly providing data in the order submitted to the Seller.

4. DELIVERY OF GOODS

4.1. When ordering Goods, you must specify the exact delivery address of the Goods, postal code,provide the exact contact phone number and other additional information. Delivery is carried out by courier.

4.2. Please note that the indicated Goods delivery times are preliminary. Although we always try to fulfill the order as quickly as possible, sometimes its preparation may take longer due to a large volume of orders or the workload of delivery service providers. The Seller always informs about the delivery status.

4.3. In cases where, upon receiving the Goods, you notice that the ordered Goods are not in the shipment, inform the Seller immediately.

4.4. The Goods are delivered packaged, taking into account their nature, to ensure that the Goods are suitable for their intended use.

4.5. The Buyer must immediately inform the Seller if the shipment is delivered in a crumpled or otherwise damaged package, if the shipment contains unordered goods or an incorrect quantity, or an incomplete product set.

4.6. If the Buyer notices packaging damage during delivery, they must indicate comments in the shipment delivery document provided by the courier or draw up a separate act regarding these damages. The Buyer must do this in the presence of the courier. If such actions are not performed, the Seller is released from liability to the Buyer for damage to the goods related to packaging damage that the Buyer did not mark in the courier's goods delivery document.

4.7. The Buyer undertakes to accept the goods themselves. In the event that the Buyer cannot accept the goods themselves, and the goods are delivered to the specified address, the Buyer has no right to make claims against the Seller regarding the delivery of the goods to an inappropriate entity.

5. EXCHANGE OR RETURN OF GOODS

5.1. Withdrawal from the contract within 14 days (applies only to consumers)

5.2. If you purchase Goods in the E-shop as a consumer (i.e., a natural person acting for purposes unrelated to their business, trade, craft, or profession (consumer purposes)), you have the right to return the Goods purchased in the E-shop within 14 (fourteen) calendar days from the day you received the Goods. You can do this without stating a reason (i.e., by exercising your right to withdraw from a distance contract, which is granted to you by Lithuanian and European Union law).

5.3. Please note that there are Goods in the E-shop that fall under the exceptions provided for in Article 6.228(10) part 2 of the Civil Code of the Republic of Lithuania, where consumers do not have the right to withdraw from the contract discussed in the previous paragraph. Therefore, you cannot withdraw from the contract and return Goods made according to your special instructions, which are not pre-made and are made taking into account your personal choice or instruction (for example, custom-ordered carpets), without stating a reason.

5.4. If you withdraw from the contract, when returning the Goods, they must be unused, with labeling tags and in the original packaging, undamaged and not having lost their commercial appearance. We will consider that you have fulfilled this requirement if, when trying out the Goods, you have performed only such actions that are necessary for the evaluation of the Goods and which you would normally perform if you were inspecting the Goods in a physical store.

5.5. To exercise this right, you must notify the Seller by email at info@kilimunamai.lt no later than within 14 (fourteen) calendar days from the date of receipt of the Goods and attach proof of purchase. You can use the sample return notification form provided here.

5.6. If you decide to withdraw from the contract, you must send the Goods back to the Seller at the address specified at the beginning of these Rules immediately and in any case no later than within 14 (fourteen) calendar days from the day you notified the Seller of the return by email. The deadline will not be violated if you sent the Goods before the expiry of the 14 (fourteen) day period. You must cover the costs of returning the Goods to the Seller.

5.7. If for any reason you wish to return a product purchased in the www.kilimunamai.lt online store, please inform us by email within 14 days of receiving it:info@kilimunamai.lt and we will contact you to discuss the return process or exchange options for the item.

5.8. If you withdraw from the contract, the Seller undertakes to refund all money paid by you for the Item and its delivery to you to the bank account specified by you no later than within 14 (fourteen) calendar days from the day you notified the Seller of the return by email, but not earlier than the Seller receives the returned Item (unless the Seller, at its discretion, decides not to wait for the returned Item).

5.9. Wholesalers and other buyers who purchase in the E-shop for non-consumer purposes do not have the right to withdraw from the contract, unless otherwise explicitly agreed in writing with the Seller.

5.9. Defective Items

5.9.1. Items are subject to the statutory warranty provided for in the laws of the Republic of Lithuania, meaning that the Seller is responsible to the consumer for any non-conformity of the Items with quality requirements at the time of delivery of the Item and which becomes apparent no later than within two years from the delivery of the Item.

5.9.2. If an Item purchased in the E-shop is of poor quality, you have the right, in accordance with the procedure and terms provided by law, to request that the Seller free of charge eliminate the defects of the Item or replace the poor quality Item with a good quality Item, and in cases provided by law, to request a corresponding price reduction, or to return the Item.

5.9.3. If you believe that an Item purchased in the E-shop is of poor quality and you have identified its defects, you must notify the Seller by email: info@kilimunamai.lt no later than within two months from the day of discovering the non-conformity, and state your preferred solution. When notifying about a poor quality Item, provide a detailed description of where and when the defect occurred, attach photos of the Item and the defect, and other related information that will help identify the defect.

5.9.4. The buyer's rights related to poor quality Items are exercised in accordance with the procedure provided for in Articles 6.364(1)- 6.364(3) of the Civil Code of the Republic of Lithuania.

6. INTELLECTUAL PROPERTY

6.1. Trademarks and other marks used to mark the Items belong to the Seller and/or other persons and are protected by legal acts. All intellectual property rights to the Items and their individual parts also belong to the Seller and/or other persons.

6.2. The trademarks and logos used in the E-shop, the domain name, the E-shop itself and the website on which it is hosted, as well as all their individual elements, including texts, photographs, drawings and all material contained in the E-shop and on the website, the presentation, appearance and design of any page of the E-shop or website, and all intellectual property rights thereto belong exclusively to the Seller and/or other persons. You undertake not to copy, modify or otherwise use these intellectual property objects without the separate written consent of the rights holder.

7. LIABILITY

7.1. The Seller's liability for the quality and delivery of the Items is established in the applicable legal acts.

7.2. You must provide the Seller with all correct and complete information requested. You are responsible for providing the correct delivery address for the Items.

7.3. You are responsible for the security of your username, password, or other data that allows you to log in to the E-shop. However, if you notice that someone is using your username and password without authorization, contact the Seller immediately.

8. AMENDMENTS AND TERMINATION

8.1. The Seller may change these Rules from time to time. The latest (current) version of the Rules will always be visible and accessible in the E-shop. Before confirming the order, you must familiarize yourself with the version of the Rules in force at that time. Each order will be subject to the version of the Rules that was in force at the time of confirmation of such order.

8.2. The Seller shall have the right to discontinue (terminate) the operation of the E-shop at any time.The termination will not affect the purchase-sale agreements valid at that time.

9. OTHER CONDITIONS

9.1. These Rules and any purchase-sale agreement are concluded and shall be interpreted in accordance with the laws of the Republic of Lithuania.

9.2. Any disputes, disagreements, or claims arising from or related to these Rules or a separate purchase-sale agreement, as well as issues of their violation, termination, or validity, shall be resolved in the courts of the Republic of Lithuania in the manner prescribed by the laws of the Republic of Lithuania. The non-judicial consumer dispute resolution body competent to resolve consumer disputes arising from these Rules is the State Consumer Rights Protection Authority (address: A. Goštauto g. 12, LT-01108 Vilnius, tel. (+370 5) 262 6751, e-mail tarnyba@vvtat.lt; website address: https://www.vvtat.lt, a request or complaint can be submitted electronically through the Consumer Rights Information System (VTIS): https://vtis.lt/). A list of consumer dispute resolution bodies in all European Union countries offering pre-trial dispute resolution procedures is provided here: https://ec.europa.eu/consumers/odr/main/?event=main.adr.show2. A complaint to Lithuanian and other EU state institutions can also be submitted through the electronic dispute resolution platform https://ec.europa.eu/odr/.

9.3. All warnings or other notices related to purchases in the E-shop, these Rules, will be provided by e-mail (when sending to the Seller - to the e-mail address specified at the beginning of the Rules, when sending to You - to the e-mail address provided during the order).

9.4. If any of the provisions of these Rules is or becomes completely or partially invalid, the validity of the remaining provisions shall not be affected.
